Waxman Litigation represents companies, boards and executives in business litigation, internal investigations, white-collar defense and court-appointed receiverships, from an office at Friendship Heights on the District line. The firm acts for the company — not for the employee, the relator or the claimant on the other side. That is a deliberate position, and it means the firm can take a company’s matter without the conflicts that come from also representing people who sue companies.

White-Collar Defense & Government Enforcement

Company-side defense in federal investigations: subpoenas and search warrants, fraud offenses, False Claims Act defense, and the obstruction exposure created by the response itself.

Court-Appointed Receiverships

Service as court-appointed receiver or custodian over a company, and representation of parties in receivership and judicial dissolution proceedings.

Who you would be working with

Seth B. Waxman spent 13 years as an Assistant United States Attorney in the District of Columbia, roughly eight of them on fraud and public corruption. NPR, introducing him for an interview on the Manafort prosecution, described him as a federal prosecutor who “served under Presidents Clinton, George W. Bush and President Obama.” He is listed in The Best Lawyers in America for White-Collar Criminal Defense and Commercial Litigation.

If it is urgent

Some matters cannot wait for an ordinary schedule. If your company has received a grand jury subpoena, is facing a search warrant, has just been contacted by federal investigators, or needs an emergency injunction because assets or information are moving, say so in the first line of your message.

One thing to do immediately in any investigation: stop routine document deletion. Destroying records to impede a federal matter is a separate federal offense carrying up to 20 years, and it reaches conduct in contemplation of a matter — before anything formal exists.
